A PERFECT STORM

A storm can be beautiful, powerful and deadly just as in life humankind exhibits rage, fear and desire. The orchestrated music on the A Perfect Storm CD allows you to view all aspects of a storm by incorporating the beauty, power, rage, fear and desire into musical notes that raises your emotion to the level of creation. Enjoy the magnificent journey that you have elected to embark upon through the purchase of A Perfect Storm.

1. SERENITY
Don’t you remember the days of being lively and carefree? Serenity makes you want to daydream again of happy times, forget about the negative attitudes or events, believe that anything is possible and accentuate the positive emotions or thoughts. Serenity makes you believe that every thing desirable is simply awaiting your call into materialization. I suggest that you place Serenity into your CD player whenever your mood needs to be lifted up and then prepare for a memorable experience into the outer dimension of time and space.

2. GENTLE BREEZE
Bluesy jazz is an accurate description of Gentle Breeze. The lightly plucked main melody of the acoustic guitar beckons a response from the mellow flugle horn. Such a combination results in a sweet sound that has your hips gently moving from side to side while your body unconsciously sways in the breeze. Now close your eyes and let the blend of the melody and rhythmic accents in Gentle Breeze bathe your senses with its silky smooth pace. Gentle Breeze is simply alluring. You will find it hard to resist listening to the CD over and over again.

3. DISTANT THUNDER
Listen to Distant Thunder while you relieve your stress by enjoying the beautiful scenes of a storm in your mind’s eye. Let Distant Thunder soothe your nerves and the musical notes feel like pearly beads of rain massaging your face, back, thighs, legs, feet, hands and fingertips. Meditate on and visualize the different aspects of the storm as you hear the organ mock the distant thunder as it steadily draws nearer; feel the wind from the saxophone as it gradually grows in intensity; and see the beauty of the lightning that splashes an artful display of differing patterns upon the landscape of your mind through the trumpet in Distant Thunder. When you awaken from this splendid meditation and quietude, your body and mind will feel refreshed ready to successfully tackle the “hustle and bustle” matters of every day life. Distant Thunder has prepared you well.

4. PASSING STORM
After a storm a person may wonder about the beauty of its practicality. Think of the fact that a storm spreads seeds (ideas) over a vast distance. These seeds (ideas) eventually sprout, grow and ripen for harvest: A storm’s practicality. As the seeds (ideas) change and mature, their beauty is revealed. It is up to the observer to see and understand the revelation. All of this wonderful perfect practicality is illustrated within Papa Bass’s Passing Storm. Listen to the soprano saxophone sing about the glorious perfection of the storm while the electric piano reminds you of its practicality. Papa Bass’s portrayal of a storm’s aftermath in Passing Storm will sweep you up and engulf you in a delightful array of dancing rhythms. Allow yourself to be pampered by the sounds of Passing Storm. You deserve it!

5. GALE FORCE WINDS
The string and woodwinds in Gale force Winds create a massive symphony that embodies the reality of being in the midst of gale force winds swirling around your body. Yet, the repetitive plucking of the strings is somehow soothing and superbly complements the full round deep notes of the bass guitar as they alternatively share the lead (Yes, the bass guitar plays the melodious lead in Gale Force Winds.). This song beckons you to embrace its boldness.

6. A PERFECT STORM
This Perfect Storm is truly a rewarding experience because it makes you feel good on the inside and smile on the outside as it carries you upward in the wind to a higher vibration. Enjoy awakening of your senses to the brilliance of a soprano sax’s solo that is masterfully played. Even the intermittent plucking of the acoustic guitar doesn’t interrupt the melodic transitions of this piece; in fact, the acoustic guitar is adding just the right “pluckeroo” but gentle touch. Let me put this musical rendition into its proper perspective by describing A Perfect Storm as “contemplatively smooth.”

7. HEAVY RAIN
Hear the rolling thunder and rumbling echoes? See the split second lightning? Then why does Heavy Rain make you feel like dancing? Heavy Rain’s long, flowing notes combined with the bouncing rhythm of the bass guitar makes you want to get up and move your legs, arms, feet and head. This is rhythmic jazz with pizzazz at its best. Heavy Rain is a perfect song for your Pilates workout.

8. RAIN DANCE
During a storm one ponders its beauty and perfection. The wind, rain and lightning come together into one magnificent symphony then yields to a gorgeous day with blue skies, white fluffy clouds and a warm bright sun. Rain Dance engulfs all of this beauty as it allows the bass guitar, drum, electric piano, strings, french horn, and soprano saxophone levy a glorious symphonic sound upon your ears. Enjoying the beauty of a storm brings forth love in your heart that must be shared. Share this spirit of love that Rain Dance generates within your heart with others as Papa has shared his heart with you. Rain Dance is a lovely spicy musical mix.

9. SERVE WEATHER
During Severe Weather there will be much wind, strife, pain, toil and tribulation; but, just like the biblical Job you must hold on to your faith until deliverance arrives. If you are faithful like Job, your reward will be greater than your wildest dreams. This is the secret of Severe Weather: There is always a blessing in every adversity. Papa Bass artfully reveals the secret in the music of Severe Weather. Listen to the song carefully as it lulls you into understanding its secret, and believe in possibilities.

Thirty Twice

1. Try Smiling 7:45

Try Smiling simply says in a soothing melodic manner: I’ve arrived on the scene and have only just begun to imprint my style of living on the tapestry of life. This is truly mood music that makes you want to dance and sway with your partner. Enjoy sharing the experience of closeness as you immerse into a realm of music that refreshes the senses. Additionally, allow yourself to become mesmerized by the almost spiritually uplifting crescendo of the string instruments as they make a grand entrance joining their clear and crisp musical notes that lightly cascade a midst of pure delight upon you while blending masterfully with the sensuous blare of the brass and percussion instruments. Try Smiling definitely arouses the gaiety and playfulness of youth within your body.

2. Deep Kimchi 6:59

This tune is perky. It makes you want to bounce through your daily activities as the Deep Kimchi causes the adrenaline to rise within you. Doesn’t the call and response between the piano with all of the trills and the organ remind you of how adventurous, carefree and loved you once felt? Deep Kimchi is full of surprises: Just when you focus upon the melody of one instrument another one enters the picture at precisely the right moment that mirrors the varied experiences people encounter in daily life.

3. Living Large 8:17

Slow, deliberate and intentional are all adjectives describing Living Large. Take life as it comes and patiently deal with each crisis in order to successfully master it, the wise sage advises and the steady cadence of the piano music played by hands firmly pressing each key exemplifies. Living Large slowly but sweetly creeps into the very essence of your being and leaves you with a universal feeling that all is well in your life.

4. Mid-Life Crisis 8:59

Maturity is represented by the mellow, smooth, low texture of the guitar, piano and flute interplay. Yet, listen to the fluttering notes of the flute and ascending trills of the piano as they flirt with your imagination and seem to beckon you to move into another stage of your life—something new and thrilling that awakens your slumbering consciousness.

5. I’m Thirty Twice 9:48

I’m Thirty Twice will eventually be remembered as the “I am proud song” because it brings to the surface of the mind graduation (successful accomplishment), joyful reflections upon other experiences and positive thoughts of the future. Youthfulness is in the spirited piano notes as they relate I’m Thirty Twice. The suave saxophone playing places a “swagger within your hips” and picks up the melodious notes conveying I’m Thirty Twice. This majestic piece is truly a masterpiece extraordinaire.

6. Full Tilt Boogie 8:21

Pat your foot. Now pat both of your feet. Ready. Set. March! If the other songs on the Thirty Twice CD don’t have you moving your feet then Full Tilt Boogie will. You can’t sit still on Full Tilt Boogie. Your shoulders will be moving. The feet will be moving. The hips will move and your face will show the “I AM all that” attitude. PAPA BASS makes the organ jam. Pay particular attention to Papa’s footwork on the organ’s bass pedals. Hold your hands up folks and walk on through life with Full Tilt Boogie while swaying to the beat, prancing to the cadence and smiling with attitude.

7. Once Upon MyYouth 9:11

Splendor in paradise is Once Upon My Youth. The tempo of the string instruments returns you to the cool, crisp and gentle breeze days of spring a.k.a. youth. Notice the light plucking in the background reminiscent of the carefree “skipping through life” teenage years. However, the piano with its clear sustaining notes keeps you centered on the main theme of Once Upon My Youth.

8. Remember Quickie 13:43

Oh gosh! Could Papa be thinking what I am thinking? Nevertheless, Papa’s notes are clean, quick and the tongue on the trumpet is rolling. I love Remember Quickie with its mambo themes throughout. Remember Quickie makes you want to raise your hands to the heavens and cry out “Yes, Papa I hear you!”

9. Fuzzy Logic 5:28

Fuzzy Logic sounds like its name but the musical blend of the instruments is exceptional. A lot of thought went into orchestrating Fuzzy Logic. This song makes you want to hold your “honey” close and absorb the music as you indulge in sensuous delight. Fuzzy Logic is perfection.

Your Secret WAS Safe With Me - June 3, 2006

What’s All The Racket?

What’s All the Racket is the story of the past and present trials and tribulations of the common-law trademark WindowPad as it seeks to protect its name from the slimy hands of Adversary. WindowPad made its debut into interstate and international commerce in 1984 as the trademark of its software product using overlapping windows whereas Adversary reached the marketplace late in 1985. WindowPad was identified as a trademark within the Copyright Registration No. TX 1-453-605 for the software product (GOTO http://www.copyright.gov/records/cohm.html CLICK "Registration Number" and type in the registration number TX 1-453-605 to view the owner and other information relating to WindowPad.). The Adversary, recognizing the benefits of having a “catchy,” easy to recall name like WindowPad, arrived on the interstate commerce scene with its software product in 1985 bearing a derivative of WindowPad’s name. Since 1994(date the Adversary was formally notified of WindowPad’s superior rights), WindowPad has been in a fiery dispute with the Adversary who has gained extraordinary profits from WindowPad’s derivative.

Review the Playbill for WindowPad as you listen to Papa Bass’s picturesque music, then go to the websites indicated and read all of the material submitted (request to view the material that is presented with titles only and not “hot-linked” via the Freedom of Information Act or PACER). Papa sets WindowPad’s story to music in such a captivating and mesmerizing manner that it certainly invokes the memory of Mahatma Gandhi’s pensive statement: “First they ignore you, then they laugh at you, then they fight you, then YOU WIN.”

What’s All The Racket?

1. WindowPad

WindowPad was stable in the marketplace in 1984. Apart from the fact that the software product bearing its name was selling well something attracted the attention of Adversary. Exactly what stood out about the name is unknown: Perhaps it was the overlapping windows in its software or that the common-law trademark carried a “catchy,” easy to remember name with a symbolic meaning that possessed staying power. Nevertheless in 1985, a name derived from WindowPad appeared written upon a competitor’s software product. Note the dates of entry into interstate commerce: WindowPad entered in 1984 whereas Adversary entered in 1985 with a derivative name.

Papa Bass’s musical rendition of WindowPad is silky smooth and represents stability. The song is a sleek mixture of jazz and blues with a hint of sadness relating to the ownership of its own WindowPad name being intruded upon and wrenched away.

2. How Dare You Use My Name

This piece presents a conversation utilizing high-pitched sounds, drums and bass instrumentation. It almost sounds as if an argument is taking place that is very similar to the back and forth bickering between WindowPad and its Adversary from 1994 to the present. What a brilliant mind (or should it be called mine field) Papa Bass has that enables him to capture a moment in time with a perfect musical production.

3. Intellectual Racketeering

The long sustained notes of the organ with its stomping, grinding sound is reminiscent of a thief in the night that steals a trademark’s identity (WindowPad) and relishes in the knowledge that he has performed the PERFECT CRIME. This delighted thief commits a premeditated act of identity theft and proceeds to make profits from the stolen identity and therein lies the Racketeering; thereby, stepping and dancing on the back of the rightful owner of WindowPad. Additionally, hear the muted trumpet in the background of Intellectual Racketeering that is representative of WindowPad trying to lift its voice through the mirage and let the world know of the persecution it suffers under the feet of an enormous Adversary. Intellectual Racketeering wonderfully embraces WindowPad’s feeling of anguish and frustration.

4. Derivatives

WindowPad’s toes have been stepped on at least 60 times by Adversary. Go to http://www.uspto.gov/ebc/index_tm.html and submit a query on Registration No. 1872264 (GOTO website, CLICK “Search,” Then Select “Free Form Search,” Enter, Then type 1872264 and CLICK “Submit Query”) to see 60 derivatives of WindowPad for yourself. Now GOTO Page 18 of TTABVUE: Google TTABVUE then type in Registration No. 1872264, click on the Plaintiff, the first file/top right corner, then GOTO Page 18 of the data and look for the words “En Fleur Corp.” (a.k.a. Papa Bass) i.e., the very LAST FILE.

Question: Why is WindowPad (Petitioner En Fleur) the very last file when all files according to TTABVUE’s notification are in “reverse chronological order” (WindowPad was filed in 1997 whereas the TTABVUE’s placement implies that the case was the first one ever filed many years prior to 1997)? Is the WindowPad case being HIDDEN? Nevertheless, as the Bible says all things hidden will be revealed. (Mark 4:21-22 and Luke 8:16-17)

BUT BEFORE you leave on your “seek and you shall find” mission, listen to the wooden blocks in the rhythm of Derivatives simulating the sound of many feet stepping all over something—maybe WindowPad (Remember that copying is the sincerest form of flattery and it can also validate the strength of a common-law trademark like WindowPad.). Adding to the melodious splendor of Derivatives are the sweet sounds of many trombones arriving right on time to complement the wooden blocks. Take some time out to relax in your favorite chair and enjoy the radiant rapturous arrangement of Derivatives as you ponder what you’ve just discovered. Aren’t Revelations fantastic?

5. Twenty Plus Years Of Infringement
Listen to the pounding upon the keys: WindowPad that appeared in commerce in 1984 with overlapping windows is vocalizing its displeasure with the derivative that pounced upon WindowPad’s territory in 1985. The interpretation of the clanging of the cymbals and ringing of the triangles in Twenty Plus Years of Infringement relate to the intruder that the bell is “tolling.” Twenty Plus Years of Infringement also includes a “song and dance” of the percussion instruments with the bass guitar, and the musical routine appears to be saying to the intruder “Enough! You will step on me no more. WindowPad will not go down without a fight, will not go quietly into the night but will stand up and fight for its rights.” Note below the “song and dance” of WindowPad then research the data online even request to view the material that is presented with titles only and not “hot-linked,” i.e., the “hidden” data files (make the request through the Freedom of Information Act or use PACER where appropriate) and read the evidence submitted for yourself. In other words, you be the judge.

6. Justice Has Failed Me

The saxophone playing a melody! Have you ever heard such sweetness? Leave it to Papa Bass to create such a sweet, rich, full but unthinkably light sound with a most unlikely instrument, a saxophone. Papa Bass you truly are a genius. In addition, imagine Justice just dancing all around the truth, laughingly devising ways to make old law apply to the circumstances in order to give the interloper dominance over WindowPad who appeared first in commerce thereby epitomizing Justice Has Failed Me. Listen to the agility of the light, soft notes of the saxophone as it playfully bounces amidst the other instruments. The sound of Justice Has Failed Me makes you want to lift your feet and shake your hips delighting in the warm feeling of being able to do whatever you wish. This lightheartedness causes one to visualize WindowPad’s intruder bouncing all over the floor firmly believing that it has gotten away with the goods i.e., WindowPad’s derivatives. Imagine the intruder relishing in the warm comforting knowledge that Justice has covered its eyes (see no evil), ears (hear no evil) and mouth (speak no evil) in matters that concern its evil ways—even when the facts are presented to Justice on a silver platter.

Listener GOTO TTABVUE and type in Registration No. 1872264 then look for Proceeding Nos. 92026548 and 92043487 CLICK on each file or go directly to http://ttabvue.uspto.gov/ttabvue/v?pno=92026548&pty=CAN and
http://ttabvue.uspto.gov/ttabvue/v?pno=92043487&pty=CAN, respectively to read the information submitted. Review the opinions last. Can you hear Papa’s song Justice Has Failed Me as you peruse all of the information including the material in the “hidden files” (Make a special request to obtain these files via the Freedom of Information Act or PACER.)?

7. Benevolent Despot

The name of this song speaks volumes for itself. As the adage states: If the shoe fits, wear it. The title, Benevolent Despot, resonates recent news and should sound familiar to you. Nevertheless, hear the rock licking, rocket ascending and scale gliding sounds made by Papa Bass’s trumpet as the lead. Benevolent Despot swings with devilish rhythmic grace just like a human Benevolent Despot.

8. The Bigger They Are The Harder They Fall

The title, The Bigger They Are The Harder They Fall, reminds one of the meaning behind the old cliché: Even though you are mighty and a heavyweight with a “nobody bothers me” mentality, some small entity positioned in the right place and time can strike a blow and bring you down. Now, add the following comparative matches and ETHICAL messages to the soupy musical mix as you listen to The Bigger They Are The Harder They Fall: The Mouse that Roared, David and Goliath, Battle of Jericho, The Plagues of Egypt, Moses and Let My People Go. In simile, WindowPad is David’s rock, the mouse that is heard, the horn bringing Jericho’s walls down, the plague in Egypt and the faith of Moses that frees his people. Persistence, faith, patience, perseverance always wins.

Listen to the whimsical, gay, high-pitched sounds of the flute as it is sustained by the cadence of the drums and guitar in The Bigger They Are The Harder They Fall. Close your eyes as you hear the song and visualize the movement of the water strider and basilisk lizard actually running lightly across the water’s surface to the beat of The Bigger They Are The Harder They Fall. Oh, such peace and tranquility. Papa Bass your music places me in such rapturous splendor.

9. Sweet Taste Of Victory

Use your sense of sight and sound to view the stately prance of WindowPad as it triumphantly moves to the finger trills cascading over the keys of the majestic piano. Notice how the bass clef of the piano keeps a steady beat as the melody of happiness playfully keeps the treble clef afloat. Finally truth, justice, and the law prevail for the small business entrepreneur. Sweet Taste of Victory is a fitting piece to represent to the world that the “little guy” can win.

FIRST THEY IGNORE YOU, THEN THEY LAUGH AT YOU, THEN THEY FIGHT YOU, THEN YOU WIN. - Mahatma Gandhi

Something About Her Eyes

New Orleans, often called the Big Easy and the birthplace of Jazz, is a city full of celebrants of art & life. The inhabitants are vigorous, vibrant and sensual. Jazz is their heritage and it rejuvenates them by removing melancholy moods and monotonous days. However, nothing shields New Orleanians from the perils of nature and the uncertain drama Katrina is about to unfold with its mighty winds, rain and tornados.

Something about her Eyes illustrates in music (1) the sense of calm enjoyed by the residents of New Orleans before Hurricane Katrina approached the city (High Ground); (2) the alarming fright, ghostly and sinister feeling that overcame them moments before Katrina struck New Orleans (Grieving); and (3) the stark isolation the natives felt after enduring and witnessing the devastation caused by the immense violent force of nature named Katrina (Help is on its Way and Must I Repeat Myself).

Nevertheless, proud and strong people will not stay beaten to the ground long, they RISE anew and stronger. The resilience of the indomitable spirit of the citizens of New Orleans is captured in Papa Bass’s smooth jazz rhythms of Big and Easy and Something About Her Eyes. The bold and heroic determination of the city’s people to rebuild New Orleans exemplifies their moral courage, valiant and unrelenting struggle to return to their former peaceful existence (Southern Tears, Sa La Ve, When I Get Back to New Orleans and Last Train Home). Join this “smooth jazz” trip back in time as you listen to and reflect upon the trials and tribulations of human endurance and aspiration. The New Orleanians are survivors! PaPa Bass wanted his tribute to them to be orchestrated and performed well because the people of the city deserve a masterpiece that tells the story of survivorship and triumph. You have done your job PaPa Bass!

Tracks of Something About Her Eyes

1. High Ground 8:00

Lightness, happiness, gaiety as well as an all-encompassing calypso beat; reminiscent of the city’s primordial beginnings, no one has a disturbing care in the world only the feeling of being free to do, to be and to have all the goodness of this great earth. These rhythmic sounds of New Orleans are heard throughout High Ground.

2. Sa La Ve 6:21

There is a sense of longing, reminiscing supremely of what use to be and can be again, yearning for the carefree days that were just here, but back to work beckons. The toil is made easy however by the steady soothing beat within Sa La Ve that makes you just want to lightly bounce around the room, field, street or hallway as you proceed with a daily routine. The full rounded tune blown by the horns causes the body to move from side to side in a sassy sway without thinking. Listening to a pleasurable composition like Sa La Ve is a wonderful way to work or move through an otherwise monotonous day. Ah-h-h…. Life is good!

3. Big and Easy 6:06

Big and Easy possesses a grandioso sound similar to the raucous music that often fills the poignant French Quarter. The song invokes color within the mind’s eye and has enough perkiness that you can visualize the people of New Orleans working, playing, shouting, dancing, gathering the family, friends and even strangers for a good “come one, come all” BIG TIME PARTY. Everyone in the city is carefree, unaware of the danger that is over the horizon.

4. Help Is On The Way 11.50

The pain of New Orleans is real in this piece. You can see the despondent emotional disarray of the people, feel their pain through the music and almost hear Mayor Nagin asking the President “Where is the Help?” The piano’s staccato response is similar to President Bush’s answer to Mayor Nagin’s question in that he told the Mayor and residents of New Orleans that “help is on the way.” The mournful sad melody repeats Mayor Nagin’s question that is no longer a request, yet the refrain from President Bush is still the same. Listen to “Help is on the Way” and feel the downtrodden spirit of the city’s inhabitants. PaPa Bass has captured the spirit of New Orleans’s lost souls quite well in this musical composition. Masterfully performed.

5. Must I Repeat Myself 6:44

Mayor Nagin’s song “Must I Repeat Myself.” Papa Bass employs a dynamic rhythmic style of playing the bass in “Must I Repeat Myself” that invites you to sing along with Mayor Nagin “Must I Repeat Myself.” Yes, the Mayor of New Orleans is still asking for aid from our government led by President Bush. Maybe if we all sing along with the strings of Papa’s bass guitar, the President will hear us and send the necessary aid without further delay.

6. Grieving 8:16

The syncopation of the drums and piano evokes a haunting call and answer that creates an eerie and unsettling sense of what people felt as they witnessed incomprehensible devastation. You can almost hear the people of New Orleans saying, “Look at the Devastation! What am I going to do? Won’t somebody please HELP?” In “Grieving you can see and feel the emotions of a people confronting devastation without an answer as to why it happened to them. “Grieving” is a song without words but yet you sing the words “Won’t you HELP ME” with and for the survivors of the disaster left by Katrina—as your body sways in time with the musical sounds. Additionally, there are some parts of “Grieving” that causes the imagination to actually see the strong, enormous massive hurricane wobbling and spiraling over New Orleans, literally destroying the city. Horrifying!
7. Something About Her Eyes 8:51

This piece was composed with the determination of a people in mind resonating the words “we will rebuild” with fists held high. New Orleans residents repeat during the aftermath of Katrina: Katrina you have humbled us with your might but we are not defeated. Katrina you were humongous and caused much destruction but we are a resilient people. The future lies before us and we will return to the vicinity of our homes, businesses and schools to begin anew.”

8. Southern Tears 8:08

“Southern Tears” is silky, smooth. Mardi Gras music regenerates the citizens of New Orleans and gives them hope for the future. This piece makes a person want to step to the beat and get the feet moving for there is much work to do; yet, “Southern Tears” calms the soul making it easier to get the work done. This is truly a song that should be playing within everyone’s place of employment.

9. When I Get Back To Orleans 8:05

“When I Get Back to Orleans” is slow but busy. It has a steady rhythm with the sound of triangles, sticks, drums and horns coming in right on time. This is the song to place in your CD when you want to simply think and plan for the future. Each resident of New Orleans has gone through such a period of contemplation and planning. For those residents still in this phase, I suggest that they purchase “Something About Those Eyes” and listen to “When I Get Back to New Orleans” to aid in the thinking and rebuilding process.

10. Last Train Home

Jubilation! “Last Train Home” is joyful and makes you want to dance ecstatically, shout for joy and feel peaceful due to a job well done at the same time. Papa Bass ended this CD with the perfect song of celebration.
